Dr Ermioni Xanthopoulou, Senior Lecturer in Law at Brunel Law School, recently had her article article ('The European Arrest Warrant in a context of distrust: Is the Court taking rights seriously?') published in the European Law Journal.
Amidst growing distrust towards certain Member States, there has been a strengthening of the position of fundamental rights in the execution of a European Arrest Warrant (EAW).
By contextualizing the situation, the article contends that despite being confined by specific circumstances, the prevailing distrust has presented a significant opportunity for the European Court of Justice to seriously consider rights, setting the stage for future case-law developments.
